The problem being addressed is the failure of existing environmental laws to prevent the collapsing integrity of our waterways.  Current environmental laws are premised on nature as property, to be used for human desire and profit. Consistent with this underlying assumption, our environmental statutes are generally tied to the minimum necessary health of the waterway to protect desired (i.e., as opposed to necessary) human uses.
